L’arachide fait partie des 14 substances à déclaration obligatoire mentionnées à l’annexe III bis de la directive européenne (Communauté Européenne, 2003; Communauté Européenne, 2006; Communauté Européenne, 2007) transposée dans la législation belge (S.N., 2003b; S.N., 2008). Il s’agit de substances présentes dans des aliments préemballés et dont la mention dans la liste des ingrédients est obligatoire car elles sont susceptibles de provoquer des effets indésirables chez les personnes sensibles. La dénomination telle que mentionnée dans la législation, obligatoire sur l’étiquetage quelle que soit la forme sous laquelle l’allergène est présent lorsqu’il a été mis en œuvre, est la suivante : «Arachides et produits à base d’arachides».
En pratique, lorsque l’arachide ne fait pas partie de la liste des ingrédients de l’aliment mais qu’il y a des risques de contamination croisée (présence fortuite de l’allergène : allergène caché), l’industriel peut en faire mention sur l’étiquetage par souci de précaution. Il s’agit d’une démarche volontaire de l’industriel, car cela n’est pas obligatoire légalement, mais c’est cependant fréquemment utilisé par les industriels. On parle dans ce cas ‘d’étiquetage préventif’ (Eurasanté, 2004a). Celui-ci se traduit par des phrases telles que «Est fabriqué dans un atelier qui utilise/manipule…» ou «Peut contenir des traces d’arachide». N’étant pas une obligation légale, cet étiquetage peut revêtir différentes formes et chaque société possède ses propres mentions. Cet étiquetage de précaution, avec ses multiples formulations, ne facilite donc pas toujours la vie des personnes allergiques qui doivent jongler avec les différentes dénominations utilisées.
